Fortune State lawmakers changed the rules five years ago to allow immigrants living in the country illegally to pay in-state tuition at New Jersey’s colleges and universities. But, the state stopped short of giving the “Dreamers” any money to help pay for tuition. Gov. Chris Christie nixed legislation in 2013 that would have opened up the state’s college financial aid program to unauthorized immigrants. With Republican Christie gone, the proposal to give financial aid to unauthorized immigrants is back in Trenton and is moving closer to becoming law. The financial aid bill, S-699, was approved by the Demorcrat-controlled state Senate in a 26-10 vote Monday. An identical bill still needs to be approved by the Democrat-controlled state Assembly before it could head to Gov. Phil Murphy’s desk. Murphy, a Democrat, has expressed support for the idea. A companion bill, S-700, was also approved by the Senate on Monday. It would make the American-born children of unauthorized immigrants eligible for college financial aid in New Jersey. The ACLU was among the groups praising the Senate for advancing the legislation. “Today, the Senate sent a clear message that all of New Jersey’s students should have access to financial aid, no matter their immigration status,” said ACLU-NJ Senior Staff Attorney Farrin Anello. “Access to in-state tuition was an important first step, but without eligibility for financial aid, college simply is not attainable for most students.” Here’s how the program would work: Who would be eligible? The legislation allows students living in the country illegally to apply for college financial aid in New Jersey if they meet the following criteria: Attended a high school in New Jersey for three or more years. Graduated from high school or received a high school equivalency diploma in New Jersey. Enrolled at a public institution of higher education during the Fall 2013 semester or later. Filed paperwork with their college stating they have either applied to legalize their immigration status or will do so when and if the law changes. An amendment to the bill would also allow unauthorized immigrants attending the state’s private colleges to apply for financial aid. How much money could unauthorized immigrants get for college? The legislation calls for the state Higher Education Student Assistance Authority and the Office of the Secretary of Higher Education to set up procedures and applications for unauthorized immigrants to apply for college financial aid. Immigrants living in the country illegally would be able to apply for the same state financial aid programs as legal residents, including Tuition Aid Grants, or TAG awards, for low-income students, according to the legislation. Though state financial aid is granted based on need, some students are able to get enough aid to cover most or their college tuition and fees. However, financial aid often does not cover books, transportation and other college costs. Rutgers, the state’s largest university, currently charges the average in-state undergraduate $14,638 in annual tuition and fees on the New Brunswick campus. The bill goes up to $27,090 once room and board are added to the bill. The current maximum TAG award for Rutgers students is $9,656, though low-income students are often able to get other financial aid and scholarships to help make up the difference to cover their full tuition bills. Would unauthorized immigrants be able to apply for Pell Grants and other federal financial aid? No, the bill would only allow unauthorized immigrants to apply for college financial aid in New Jersey. Federal law still forbids immigrants living in the country illegally from applying for Pell Grants and federally-backed student loans. Could unauthorized immigrants get private scholarships and college financial aid? Yes, immigrants living in the country illegally are already eligible for many private scholarships. Some colleges, including Rutgers University, also grant scholarships to unauthorized immigrant students. How much would this cost New Jersey taxpayers? The state’s Office of Legislative Services said it would be impossible to determine exactly how many unauthorized immigrants would apply for and qualify for state financial aid. But, the office estimated it would cost about $4.47 million in additional taxpayer money to cover financial aid awards for unauthorized immigrant students for one year. That is about a 1 percent increase in the current state budget for TAG awards. Researchers reached the estimate by taking the average TAG award for a student at a four-year college — currently $7,451 per recipient — and multiplying it by 600 students. A 2015 report estimated about 600 students unauthorized immigrants would qualify for in-state tuition at the state’s four-year colleges. But the state analysts ackowledged they did not have enough information to estimate exactly what the change in the law might cost the state. “While the OLS does not have sufficient information to determine the amount of financial assistance for which students would become eligible, existing data suggest that the fiscal impact would be small relative to current appropriations,” their report said. When would this start? The Senate legislation introduced by state senators Teresa Ruiz, Sandra B. Cunningham and Nellie Pou, all Democrats, calls for the financial aid program to be open to unauthorized immigrant students immediately for the current school year. Would applying for college financial aid expose Dreamers and their families to federal immigration authorities? The legislation forbides the Higher Education Student Assistance Authority and the Secretary of Higher Education from requesting any information “about the citizenship or immigration status of the student or the student’s parent or guardian” when they apply for financial aid. What has to happen next? The legislation was approved by the state Senate Monday. But, an identical bill still has to be approved by the Assembly, where some lawmakers oppose the idea of giving taxpayer-funded tuition assistance to immigrants living in the country illegally. If both the Assembly and Senate approve the legislation, it needs the governor’s signature to become law.
