As Adler said:
In the case of immigration, the President has far more discretion than he does in any other area of policy. It’s been recognized by Congress, it’s been recognized and used by presidents of both political parties, it’s been recognized by the courts. And this is just an area where the president has a lot more leeway to do things that are potentially controversial, but they’re lawful sorts of things that have been done for quite a long time.
